Introduction and User Eligibility At Comfy Overnights, we own, manage, and lease properties available for both short-term and long-term rentals. By using our services, you confirm that you are at least 18 years old—or that you have consent from a legal parent or guardian. It is essential that you keep your account information accurate and up to date. Comfy Overnights reserves the right to decline service or terminate accounts if any of the provided information proves false.
Booking Procedures and Payments A deposit equal to 50% of the total booking amount (including taxes) is required when you reserve your stay. The remaining balance must be settled prior to your arrival. We accept various payment methods, and by booking, you authorize us to charge your chosen payment method for the full amount along with any additional fees incurred during your stay.
Flexible Cancellation Policy Our cancellation policy is designed with flexibility in mind. For a full refund, cancellations must be made at least 5 days before check-in. Please note that any reservation changes may incur extra fees, so be sure to review our specific cancellation terms at the time of booking.
Security and Damage Deposits A security deposit is required when you book your stay. Should any damages exceed this deposit, the excess will be charged to the credit card on file. Please be aware that reservations are not available to individuals under the age of 25.
Occupancy Rules and Property Maintenance The number of guests must not exceed the maximum occupancy specified for the number of bedrooms in the property. Children over the age of 4 count toward this limit. Throughout your stay, the property should be kept clean and orderly. Any damages or excessive cleaning required after your departure will result in charges against your security deposit.
Smoking and Noise Regulations All Comfy Overnights properties enforce a strict non-smoking policy indoors. Violations may lead to a fine of up to $500, with additional charges applied for cleaning or any damages incurred. Quiet hours commence at 11:00 p.m.; any disturbance that compromises the comfort of our neighbors may result in fines, and in severe cases, expulsion from the property.
Pet Policy Pets are not permitted on our properties. Should evidence of pets be discovered during your stay, a fine of $500 will be deducted from your security deposit, and any additional damages caused by pets will be charged to you.
Identity Verification Clause By making a reservation, you declare that you are the person you claim to be. Providing false information or booking under a false identity is considered fraudulent and may lead to criminal charges.
Guest Responsibility and Limitation of Liability Parents or guardians are solely responsible for the safety of their children during their stay. Comfy Overnights is not liable for any incidents resulting in injury, death, loss of personal belongings, or damage to personal property. No refunds will be issued for situations beyond our control, such as power outages, internet disruptions, or natural disasters. Our liability is strictly limited to the reservation amount paid.
Conflict Resolution Any disputes arising from these terms will be resolved through binding arbitration in a manner that is both prompt and cost-effective. By agreeing to these terms, you waive your right to pursue litigation in court or to participate in any class action lawsuits.
Force Majeure Comfy Overnights is not liable for delays or failures in performance resulting from events beyond our control, such as natural disasters, government actions, or other emergencies.
Indemnification By using our services, you agree to indemnify and hold Comfy Overnights harmless from any claims, damages, or expenses—including legal fees—that might arise from your use of our property.
Governing Law and Jurisdiction This agreement is governed by the laws of Ontario. Any legal disputes shall be resolved exclusively in the courts of Ontario.
Amendments Comfy Overnights reserves the right to amend these terms at any time. Any changes will be communicated via email, and continued use of our services constitutes your acceptance of the updated terms.
Intellectual Property All content, trademarks, and data related to Comfy Overnights are our property and are protected under intellectual property laws. Unauthorized use is strictly prohibited.
Severability If any provision in this agreement is deemed invalid or unenforceable, the remaining provisions will continue to be enforceable and in full effect.
